§ 1 Scope, Customer Information
The following terms and conditions govern the contractual relationship between Dominik Heidt, Triops_Time, and consumers and businesses purchasing our goods through the marketplace. The contract language is German.
§ 2 Conclusion of Contract
(1) Conclusion of contract for items listed in auction format
a) By listing an item on the website, we make a binding offer to conclude a purchase contract for this item. We set a starting price and a timeframe (duration of the offer) within which the offer can be accepted by placing a bid.
b) You can accept the offer by submitting a bid using the bidding function. Your bid expires if another bidder places a higher bid during the offer period.
c) The contract is concluded if you are the highest bidder at the end of the auction or if the offer is prematurely terminated by us.
(2) Conclusion of contract for fixed-price items
a) By listing an item on the website with the "Buy It Now" option, we make a binding offer to conclude a contract for this item (fixed-price offer). We set a fixed price at which the offer can be accepted regardless of the expiration of the offer period and without conducting an auction.
b) The contract is concluded when you submit a bid at the fixed price using the "Buy It Now" function. Coupons cannot be combined.
c) If you submit a bid under the fixed price using the "Make Offer" option, a contract is concluded if we accept the offer. If we make a counter-offer, your offer is considered rejected. In this case, a contract is concluded if you accept our counter-offer. Bids and counter-offers are binding and valid for 48 hours.
§ 3 Customer Information: Storage of the Contract Text
We do not store the contract text with details about the item. However, you can view the details via your personal account within 60 days after the conclusion of the contract. After that, you will no longer have access to the contract text.
§ 4 Customer Information: Correction Notice
Enter your bid and/or desired quantity in the designated fields and then click the corresponding button (e.g., "Bid," "Buy It Now," or "Review Offer"). A summary page will open where you can review your information. You can correct input errors (e.g., regarding the amount of the bid or the desired quantity) by returning to the previous page using the "Back" button of your internet browser. There, you can correct your errors in the fields. If you wish to completely cancel the order process, you can simply close your browser window. Otherwise, by clicking the confirmation button (e.g., "Confirm Bid," "Buy," or "Make Offer"), your declaration becomes binding.
§ 5 Return Shipping Costs in Case of Withdrawal
Consumers have a legal right of withdrawal (see withdrawal information). In the case of withdrawal, you must bear the costs of returning the goods if the delivered goods correspond to the ordered items and if the price of the item to be returned does not exceed 40 euros or if you have not yet provided the consideration or an agreed partial payment at the time of withdrawal for an item with a higher price. However, you only need to bear the regular costs of return shipping. Additional costs arising, for example, from a change in our business location or from the use of expensive transport services at our request are borne by us.
§ 6 Limitation of Your Warranty Claims
(1) Warranty against Consumers for Used Goods
Your warranty claims due to defects in used goods expire one year after the transfer of the sold item to you. This regulation does not apply to claims for damages, claims due to defects that we fraudulently concealed, and claims from a warranty we have assumed regarding the condition of the item. The statutory limitation periods apply to these excluded claims.
(2) Warranty against Businesses
Your warranty claims due to defects in the purchased item expire one year after the transfer of risk. This regulation does not apply to claims for damages, claims due to defects that we fraudulently concealed, and claims from a warranty we have assumed regarding the condition of the goods. The right of recourse under § 478 BGB is also excluded. The statutory limitation periods apply to these excluded claims.
